Kenneth T. Montzouros is also charged with two counts of forcible touching, two counts of endangering the welfare of a child and second-degree sexual abuse, all misdemeanors.
Montzouros was arrested Jan. 17 by Dansville Police, which charged him with the misdemeanors following a joint investigation with the Livingston County Department of Social Services.
The indictment was handed up June 20 following presentation by Livingston County District Attorney Greg McCaffrey.
The crimes Mountzouros is accused of allegedly occurred Aug. 1, 2012, according to court records.
He pleaded not guilty to the original charges in February and through his attorney denied that the alleged incident ever happened. The attorney said in February that the allegations against his client first arose during family court proceedings between Mountzouros and his ex-wife.
Mountzouros in a post to an online fundraising campaign asserted his innocence and claimed he had been a victim of “parental alienation.”
